Third Party Provider Terms

Harmoney services may include data, information, software or other services provided by third parties (‘Third party providers’). Some third-party providers require Us to pass additional terms through to You. These Third-party provider terms are subject to change at the provider’s discretion and new third-party providers may be added from time to time. Therefore, if you receive any data, information, software or other services from Third party providers through the Harmoney Services, you must also comply with these terms in addition to the Harmoney Terms and Conditions. Please find below the terms of the current Third-party providers. Your use of Services containing Third-party providers’ data, information, software or other services constitute Your agreement to be bound by these Third-party provider terms.

Deutsche Boerse AG (DBAG)

DBAG is a reseller for the datafeed provided by BSE Ltd

1. Customers using real-time market data of BSE Ltd (‘BSE data’) are permitted to exclusively use the data internally and shall not make any usage of the data other than as expressly permitted. Dissemination of BSE data to third parties without the express prior written approval of Deutsche Börse AG is prohibited.

2. Customers shall:

   • Comply with all laws, rules, and regulations applicable to accessing and using the BSE data (including any restrictions imposed by BSE Ltd)

   • Cease all use of and delete and/or purge all BSE data upon the termination of its relationship with Harmoney, except to the extent such the Customer may be required by applicable law or regulation to keep copies of the data, but provided that no other access to or use of the data occurs

   • Not use the BSE data for any purpose other than as permitted by Harmoney and

   • Use the BSE data internally only

3. Customers shall not use BSE data for the creation of indices whereby the respective index in part (i.e. weightage of 25% or more on Indian securities) or in full is based on prices derived from securities listed in India for the purposes of the issuance, trading, clearing or settling of derivative financial products which are based on or benchmarked to such indices outside India. The aforementioned derivative financial products (a) refer to exchange-traded Securities with a value that is reliant upon or derived from an index level (i.e., index futures contracts and index options contracts, swaps, warrants or CFDs), and (b) do not include exchange-traded funds (ETFs) or exchange-traded notes (ETNs).

4. Customer shall not use BSE data for the purpose of conducting gambling activities (such as leagues, schemes, competitions which may involve the distribution of prize monies or comparable activities).

NSE Data & Analytics Limited

1. Customers receiving real-time market data of NSE Data & Analytics Limited are not permitted to use the data for trading or settling derivative products, issuance of overseas derivatives instruments, and/or structured products on exchange-traded derivative contracts on Indian securities traded on foreign exchanges and/ or foreign trading platforms.

2. Customers shall not create/issue/ introduce any indices/products linked to the data without prior written consent of NSE Data & Analytics Ltd.

3. Customers shall not, in any form or manner, use the data for use on any platforms/apps/websites for online gaming, virtual trading or simulation, fantasy games, or any activity of a similar nature that is prohibited under law or by regulatory and/or judicial authority.
